1. Introduction

These Terms and Conditions govern your use of the Acts Video, LLC, website (hosted on Framer) and our videography services. Operating in Texas as of March 6, 2025, we serve real estate professionals, business leaders, and unique project creators. By booking our services, you agree to these terms, which protect both you and Acts Video, LLC, from potential liabilities or misunderstandings. 2. Services

Acts Video, LLC, provides premium videography services, including filming, editing, and digital delivery of final videos for real estate promotion, corporate branding, and special projects. All bookings are subject to our approval based on availability and project scope.

3. Booking and Payment

Deposit: A $100 booking deposit is required to secure your appointment, payable via Shopify checkout on our website. This reserves your slot and initiates a legally binding contract upon payment. Final Payment: The remaining balance (e.g., $400 for a $500 total) is due upon project completion, before video delivery, also via Shopify. Payments are processed securely through Shopify Payments, with funds transferred to our bank per Shopify’s payout schedule.

4. Refund Policy

Deposits: Refundable as follows: $50 refunded if canceled before work begins (e.g., filming or pre-production), with $50 retained for administrative costs. Non-refundable once work starts on your appointment day, reflecting our invested resources.Final Payments: Fully refundable if we fail to deliver; non-refundable post-delivery. If Acts Video, LLC, cancels due to unforeseen circumstances, we’ll issue a full refund or reschedule at no extra cost. Refunds are processed via Shopify within 5-10 business days.

5. Delivery

Final videos are delivered via a secure download link (e.g., Shopify Digital Downloads or Google Drive) within 1 day of full payment, barring delays beyond our control. You’ll receive a non-exclusive license to use the video for its intended purpose (e.g., real estate marketing, business promotion). The process begins with initial contact, day 1, and then we have 48 hours to get back to you to discuss your needs. It can be immediate or within 48 hours, depending on our availability, based on workload at the time we are contacted. Once the initial $100 fee is paid for booking an appointment, we request 5 days to complete the project and share the final video link, requesting the remaining amount to be paid. Upon receiving full payment, we will provide you a link to your video within a day.. In an ideal scenario, it can be a few days turnaround; otherwise, a week is likely the time it will take for final video delivery.

6. Intellectual Property

All footage, images, and materials captured or submitted remain the intellectual property of Acts Video, LLC, until final delivery and full payment. Post-payment, you receive a non-exclusive license for use; resale or unauthorized editing is prohibited. We reserve the right to feature our work in our portfolio unless otherwise agreed in writing.

7. Client Responsibility

Provide accurate project details and timely feedback. Secure permits, releases, or access for filming locations (e.g., properties, events) and ensure a safe, unobstructed environment. Failure to comply may result in project termination without refund.

8. Liability

Acts Video, LLC, is not liable for delays or damages caused by factors beyond our control, such as weather, client equipment issues, or unsafe conditions. Our liability is limited to the amount paid for services, protecting both parties from excessive claims.

9. Force Majeure and Uncontrollable Events

Neither party is liable for delays or non-performance due to extraordinary events (e.g., natural disasters, government mandates), ensuring fairness in Texas’s dynamic environment.

10. Governing Law and Dispute Resolution

These terms are governed by Texas law. Disputes will be addressed through mediation or arbitration in Bexar County, Texas (or your business’s county), before legal action, ensuring prompt and fair resolutions.
